CDA Issues Notices to Bahria Town Residents Over Illegal Construction

The Capital Development Authority (CDA) has issued legal notices to the residents of Bahria Town Phases 1, 2, 3, 4, 5 and 6, stating that the current land use and infrastructure developed on the land are illegal. This has created panic and anxiety among the residents and investors who have large amounts at stake in the housing society. 

Details Of The CDA Notice

The formal notices received by the residents of Bahria Town have the following important points:

  • The land of Phases II, III, V, and VI (Zone-5) was marked as open space in the layout plan, which was approved in August 2000. This means that the land was not approved for any commercial or residential development.
  • The land was then handed over to the CDA through a transfer deed No. 3600 in May 2001, thereby making the land of Bahria Town Phase 1-6 CDA property.
  • According to the CDA, any building, sale, or allotment made on the plots afterward has no legal value since the land is state property.

Laws Violated

CDA acts when a violation of land use and zoning laws is identified. The main laws whose violations were found and stated in the notices are:  

  1. Section 49 of the CDA Ordinance 1960
  2. Sections 46 and 46-B of the CDA Ordinance 1960
  3. Clause 5(i)-(iii) of the ICT Zoning Regulations 1992
  4. Clauses 40-42 of the Regulations for Planning

In response to these violations, the owners of the specific properties mentioned have been ordered to show cause as to why an action should not be taken.

Actions Expected From CDA 

As a result of the violations of CDA laws and layout plan, CDA has stated the following possible actions:

  • Halting the illegal land use
  • Cancelling any building or zoning approvals granted for the site
  • Demolition or removal of the unauthorized structure altogether

This development has led to a wave of confusion among the residents who have spent their life savings to own a property at a reputable pace. Investors are concerned as to what the future of their properties is, if they can be sold, or what the resale value will be, and who will bear the consequence of any CDA action. 

The formal notices issued by CDA to the property owners in Bharia Town Phase 1-6 for land use violations made against the layout plan approved by CDA and CDA laws, as the land was approved for open spaces and does not permit any commercial or residential land use. CDA is looking forward to show cause due to panic among residents.
